Welcome to The Brain Sprinkles. "We", "us" and "our" mean The Brain Sprinkles. "You" means you, the person using this site or buying from it.

These terms cover the website at thebrainsprinkles.com and everything we sell through it (the "Services"). By using the site or placing an order you agree to them, together with our Privacy Policy, our Refund Policy and our Delivery Policy. If you do not agree, please do not use the site.

Our store runs on Shopify, which is what lets us provide the Services to you.

1. What we sell

We sell digital printable coloring books. Every product is a PDF file that you download and print yourself. Nothing physical is ever shipped to you. Product pages show the page count, paper size, file format and real preview pages so you know what you are buying before you buy it.

Colours and detail can look slightly different on your screen than they do when printed, and print results vary with your printer, ink and paper. We cannot guarantee a specific printed result on a specific machine.

We may change or discontinue any product at any time.

2. Who can buy

You must be old enough to enter into a contract where you live. Our books are drawn for adults and older teenagers — the humour and situations are based on adult life — but there is nothing in them unsuitable for a younger person who wants to colour.

3. Orders and payment

When you place an order you are making an offer to buy. The order is accepted once we have received your payment and confirmed it by email. We may decline an order, for example if we suspect fraud or if a price was listed incorrectly.

Prices are shown in the currency displayed at checkout and are the prices in effect when you order. Prices and any discounts can change at any time. There are no shipping charges, because nothing ships.

Payment is handled by Shopify Payments and the other providers shown at checkout. We never see or store your full card details.

4. Delivery of your file

Your download is available immediately after payment, on the thank-you page and in your order confirmation email. Full details are in our Delivery Policy. If your file does not arrive or stops working, email us and we will resend it.

5. Refunds

Because our products are digital and delivered instantly, we do not refund a purchase once your download has been made available, except where something is genuinely wrong with it. Our Refund Policy sets out exactly what we will always put right, and it does not affect any rights you have under the consumer law of your own country.

6. What you may and may not do with the files

When you buy a book you are buying a licence to use it, not the artwork itself. We keep the copyright.

You may:

• Download the files to your own devices
• Print the pages as many times as you like, for yourself and the people in your household
• Colour the pages however you want, in any medium, digital or on paper
• Share photographs of pages you have coloured, including publicly and on social media
• Give a page you have printed and coloured yourself to someone as a non-commercial gift

You may not:

• Share, forward, upload or resell the files or your download link
• Post the uncoloured artwork anywhere online
• Sell printed or digital copies, coloured or uncoloured
• Put the illustrations on products, including print-on-demand
• Include the pages in another book, bundle or product
• Alter the artwork and pass it off as your own, or claim authorship of it
• Use the files or artwork to train a machine learning or AI model

If you would like to use our artwork commercially, write to us. Sometimes the answer is yes.

7. Our brand and this website

The Brain Sprinkles name, logo and all text, images and design on this site belong to us or our licensors and are protected by copyright and trade mark law. You may use the site for your own personal, non-commercial purposes. You may not copy, scrape, republish or systematically extract any part of it without our written permission. Shopify's name and logo belong to Shopify.

8. Acceptable use

Use the site lawfully. Do not attempt to break, overload or gain unauthorised access to it, upload malicious code, harvest other people's personal information, impersonate anyone, or use automated tools to scrape it. We may suspend access if you do.

9. Your emails and messages to us

If you send us feedback, ideas, suggestions or photographs of your coloured pages, you allow us to use them — including publicly, for example on social media — without payment. Please do not send us anything you are not happy for us to use. We are not obliged to keep feedback confidential, to act on it, or to reply.

10. Newsletter and marketing

If you give us your email address for the free page or the newsletter, we will send you occasional emails about new books and offers. Every email has an unsubscribe link and it works immediately. We do not sell your email address to anyone. See our Privacy Policy for the full picture.

11. Third-party links and tools

The site may link to other websites or use tools provided by third parties. We do not control them and are not responsible for their content, their products or their privacy practices. Read their terms before you use them.

12. Relationship with Shopify

The Brain Sprinkles is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with The Brain Sprinkles. By using the Services you acknowledge that Shopify is not responsible for any aspect of any sale between you and The Brain Sprinkles, including any injury, damage or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with The Brain Sprinkles.

13. Mistakes on the site

Occasionally something on the site may be wrong — a price, a description, an availability date. We may correct it, and we may cancel an order placed on the basis of an obvious error, including after you have ordered. If we do, we refund you in full.

14. Availability

We try to keep the site up and working, but we do not promise it will always be available or error-free. We may change, suspend or withdraw any part of it.

15. Our liability

We do not exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by our negligence, for fraud, or for any liability to consumers that cannot be excluded under the law of the country you live in.

Subject to that: we supply digital coloring books for personal enjoyment, and our total liability to you in connection with an order will not exceed the amount you paid for that order. We are not liable for indirect or consequential losses, or for loss of profit, revenue or data.

16. If part of these terms does not hold up

If any part of these terms turns out to be unenforceable, the rest of them still apply.

17. Changes to these terms

We may update these terms. The current version is always on this page, with the date it was last changed at the top. Changes apply to orders placed after the change.

18. Law and disputes

These terms are governed by the law of the Republic of Lithuania, and the Lithuanian courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country in which you live, and you may also bring proceedings in your own country's courts.

If you are an EU consumer and we cannot settle a complaint directly, you can use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
